1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of SharkAlytics, including our website, iOS app, and API (collectively, the "Service"), operated by SharkAlytics ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

2. Eligibility

You must be at least 13 years old to use SharkAlytics. By creating an account, you confirm that you meet this age requirement. Users between 13 and 18 should have parental consent before using the Service.

3. Your Account

• You are responsible for maintaining the security of your account credentials.
• You must not share your account with others or allow unauthorized access.
• You must notify us immediately of any unauthorized use of your account.
• You may not create multiple accounts to circumvent plan limits.

4. Acceptable Use

You agree not to use the Service to:

• Upload content you don't own or have rights to
• Attempt to reverse-engineer or scrape the AI models or API
• Harass, spam, or harm other users in community features
• Circumvent subscription limits or access controls
• Use the Service for any unlawful purpose
• Upload harmful, offensive, or illegal content

5. AI Analysis Disclaimer

SharkAlytics uses AI (Google Gemini) for species identification. Results are provided for educational and informational purposes only. AI identifications may not be 100% accurate. Do not rely solely on SharkAlytics results for scientific research, legal, or conservation decisions without independent verification from qualified experts.

6. Subscriptions & Billing

Web subscriptions are processed via Stripe. iOS subscriptions are processed via Apple through RevenueCat. The following applies to all subscriptions:

• Subscription fees are charged at the start of each billing period
• Annual plans are billed once per year
• Cancellation takes effect at the end of the current billing period
• Refunds are subject to Stripe's or Apple's refund policies
• We reserve the right to change pricing with 30 days' notice

Spin Wheel Discounts: Lifetime discounts awarded via the spin wheel feature are applied for as long as you maintain a paid subscription. Discounts are not transferable and do not apply to institutional pricing.

7. Free Tier Limits

Free accounts are limited to 3 analyses per month. Limits reset on the first of each month. Analysis results on free accounts include watermarks. We reserve the right to modify free tier limits at any time.

8. Intellectual Property

SharkAlytics and its content (logo, UI design, educational content, species database) are owned by us and protected by intellectual property laws. You retain ownership of photos you upload. By uploading photos, you grant us a limited license to process them through the AI service and store them for your use.

9. Community Guidelines

Community features (available on Enthusiast and higher plans) require respectful conduct. We may remove content or suspend accounts that violate community standards, including spam, harassment, or inappropriate content.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your right to use the Service ends immediately and we may delete your data.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that AI results will be accurate. Your use of the Service is at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, SharkAlytics shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including any errors in AI identifications.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
